Terms of Service

These terms are the agreement between you and Heirloom Folio when you create a studio and share galleries on heirloomfolio.com. By creating an account you accept them; if you use Heirloom Folio for a business, you accept them on its behalf.

The service

Heirloom Folio lets photographers store their work and deliver it to clients in private galleries, with a studio homepage and emails in their own brand.

Heirloom Folio is in beta: it is free for now, and features will change as it grows. Before any paid plan starts we will tell you, and nothing will be charged without your agreement.

Your account

You need to be at least 18 and use Heirloom Folio for your work as a photographer. Keep your sign-in safe: you are responsible for what happens in your account and in the studios you share with others. If you think someone else has access, write to hello@heirloomfolio.com.

Your photos stay yours

You keep every right to what you upload. You allow us to store, copy, resize and show it, and to deliver it to the people you share it with — only to run Heirloom Folio for you, and only while it is stored here.

We don’t use your photos to advertise or to train AI, and we don’t show them to anyone you haven’t shared them with.

What you agree to

  • Upload only work you have the right to share, and share people’s photos and details lawfully, with any consent you need from the people photographed.
  • Don’t use Heirloom Folio for anything illegal, harmful or deceptive: nothing that sexualises minors, no malware, spam or phishing, nothing that infringes other people’s rights.
  • Don’t try to break, overload or scrape the service, get around its security, or resell it without our agreement.

Your clients’ data

When your galleries hold photos of people or record your clients’ email addresses, favourites and downloads, you are the controller of that personal data and Heirloom Folio is your processor under Article 28 of the GDPR. This section is our data processing agreement with you. We:

  • process it only to provide Heirloom Folio as you set it up — these terms and your settings are your instructions;
  • make sure everyone who works on it is bound to confidentiality;
  • protect it with appropriate security, including encryption in transit and limited access;
  • use only the providers listed in our Privacy Policy, and tell you before adding one, so you can object or leave;
  • help you answer requests from the people in your galleries and meet your own obligations;
  • tell you without undue delay if we learn of a breach affecting your data;
  • delete it when you delete it or close your account, apart from short-lived backups;
  • give you the information you need to show that this is done.

Keep your own copies

We take good care of your files, but Heirloom Folio is not a backup service: always keep your originals. During the beta we can’t promise the service will always be available or free of errors.

Storage and fair use

Each plan includes the storage shown on our site. If an account starts to affect others — far beyond its storage, or with unusual traffic — we will contact you to sort it out before taking any action.

Your own domain

If you connect a domain, you need to own or control it. We may disconnect a domain that no longer points to Heirloom Folio or is used against these terms.

Ending the agreement

You can delete your account at any time in Account settings. Your studios, galleries and photos go with it, except a studio you share with someone who stays.

We may suspend or close an account that breaks these terms or puts others at risk. Unless it is urgent or unlawful to do so, we will tell you first and give you time to download your work.

Liability

We provide Heirloom Folio with reasonable care and skill. As far as the law allows, we are not liable for indirect losses, such as lost profits or business, and our total liability for any claim is limited to the greater of what you paid us in the 12 months before it and €100.

Nothing in these terms limits liability that the law does not allow to be limited, such as for fraud, or for death or injury caused by negligence.

Changes to these terms

We may update these terms as Heirloom Folio grows. For changes that matter we will email account holders at least 30 days before they take effect; if you don’t agree, you can close your account before then.

Law

These terms are governed by Portuguese law, and the courts of Portugal decide any dispute. If you are a consumer, you keep the protection of the law where you live.
